Acceptance. By accessing the Site or Services, you agree to these Terms. If you do not agree,
do not use the Site or Services.
Age Requirement. You must be at least 18 years old to use the Site or Services. By using the
Site or Services, you represent that you are 18 or older.
Additional Terms. If you register for a paid subscription to the Services, you will be required to
accept our separate End User License Agreement or Subscription Agreement at the time of
registration. Those additional terms will govern your use of the paid Services.
Account Creation. To access certain features of the Services, you must create an account.
You agree to provide accurate, current, and complete information during registration and to
keep your account information up to date.
Account Security. You are responsible for maintaining the confidentiality of your account
credentials and for all activity that occurs under your account. Notify us immediately at
support@aktohcyber.com if you suspect unauthorized use of your account.
Demo Accounts. We may offer 14-day demo accounts for evaluation purposes. Demo
accounts expire automatically after 14 days and may have limited functionality. We reserve the
right to terminate or suspend demo accounts at any time.
You agree not to use the Site or Services to:
● Attack, compromise, or disrupt third-party systems, networks, or services
● Store, transmit, or distribute malware, viruses, or other malicious code
● Engage in phishing, fraud, or identity theft
● Circumvent or attempt to circumvent security controls, authentication mechanisms, or
usage limitations
● Reverse engineer, decompile, or disassemble the Services (except to the extent
permitted by applicable law)
● Store or transmit illegal, infringing, defamatory, or obscene content
● Violate any applicable law, regulation, or third-party right
● Use the Services to send spam or unsolicited communications
● Interfere with or disrupt the integrity or performance of the Services
● Access or search the Services by any means other than our publicly supported
interfaces
● Scrape, crawl, or use automated tools to extract data from the Services without our
written permission
We reserve the right to suspend or terminate your access to the Services if you violate this
Acceptable Use Policy.
Your Content. You may upload files, logs, and other data to the Services (“Your Content”). You
retain all ownership rights in Your Content.
License to Aktoh. By uploading Your Content, you grant us a limited license to use, store, and
process Your Content solely to: (a) provide the Services to you; (b) identify and fix bugs,
vulnerabilities, and security issues; (c) improve the Services; and (d) comply with applicable law.
We will not share Your Content with third parties except as necessary to provide the Services or
as required by law.
Your Responsibilities. You are responsible for Your Content and represent that you have all
necessary rights to upload it. You agree not to upload content that violates any law or infringes
any third-party right.
Removal. We reserve the right to remove or disable access to any content that violates these
Terms or is otherwise objectionable, but we have no obligation to monitor or review user
content.
We may offer beta, early access, or experimental features from time to time. Beta features are
provided “as-is” without warranty of any kind and may be modified, discontinued, or removed at
any time without notice. Beta features may contain bugs or errors and should not be used in
production environments.
Aktoh IP. The Site and Services, including all software, text, graphics, logos, and other content,
are owned by Aktoh, Inc. or our licensors and are protected by copyright, trademark, and other
intellectual property laws. You may not copy, modify, distribute, sell, or exploit any portion of the
Site or Services without our prior written consent.
Trademarks. “Aktoh,” “Sleight,” “Horseman,” and our logos are trademarks of Aktoh, Inc. You
may not use our trademarks without our prior written permission.
Feedback. If you provide us with suggestions, ideas, or feedback about the Services, we may
use that feedback for any purpose without obligation to you.
The Services may integrate with or link to third-party services, websites, or applications. We are
not responsible for the availability, content, or practices of any third-party services. Your use of
third-party services is governed by those services’ own terms and privacy policies. We disclaim
all liability arising from your use of third-party services.
Paid Services. Certain features of the Services require payment of subscription fees. All fees
are nonrefundable unless otherwise required by law.
Pricing. We reserve the right to change our pricing at any time. Price changes will not affect
your current subscription term but will apply upon renewal.
Taxes. All fees are exclusive of applicable taxes. You are responsible for paying all taxes
associated with your use of the Services.
Term. These Terms remain in effect for as long as you use the Site or Services.
Termination by You. You may stop using the Services at any time. If you have a paid
subscription, you may cancel in accordance with your subscription agreement, but you will not
receive a refund for the remaining subscription period.
Termination by Us. We may suspend or terminate your access to the Services at any time,
with or without cause, including for violation of these Terms. Upon termination, your right to use
the Services will immediately cease.
Effect of Termination. Upon termination, we may delete Your Content in accordance with our
data retention policies. Sections 6, 8, 10, 11, 12, and 13 will survive termination.
THE SITE AND SERVICES ARE PROVIDED “AS-IS” AND “AS AVAILABLE” WITHOUT
WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES
OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-
INFRINGEMENT.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE,
OR SECURE, OR THAT DEFECTS WILL BE CORRECTED. WE DO NOT WARRANT THE
ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT OR INFORMATION
PROVIDED THROUGH THE SERVICES.
YOU USE THE SERVICES AT YOUR OWN RISK. WE ARE NOT RESPONSIBLE FOR ANY
DAMAGE TO YOUR COMPUTER SYSTEM, LOSS OF DATA, OR OTHER HARM RESULTING
FROM YOUR USE OF THE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AKTOH, INC. AND ITS OFFICERS,
DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT,
INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF
PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR
RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES, REGARDLESS OF THE
THEORY OF LIABILITY AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF
SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT
OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICES WILL NOT
EXCEED THE GREATER OF (A) $100 OR (B) THE TOTAL FEES YOU PAID TO US IN THE
12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN
WARRANTIES OR DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY
TO YOU.
You agree to defend, indemnify, and hold harmless Aktoh, Inc. and its officers, directors,
employees, and agents from and against any claims, liabilities, damages, losses, costs, and
expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the
Site or Services; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any
law or third-party right.
Governing Law. These Terms are governed by the laws of the Commonwealth of Virginia,
without regard to conflict of laws principles.
Arbitration. Any dispute arising out of or related to these Terms or the Services will be resolved
through binding arbitration administered by the American Arbitration Association (“AAA”) under
its Commercial Arbitration Rules. The arbitration will take place in Fairfax County, Virginia, and
will be conducted by a single arbitrator. The arbitrator’s decision will be final and binding and
may be entered as a judgment in any court of competent jurisdiction.
Class Action Waiver. YOU AND AKTOH AGREE THAT EACH PARTY MAY BRING CLAIMS
AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS
MEMBER OR REPRESENTATIVE IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE
ACTION OR PROCEEDING. NEITHER YOU NOR AKTOH MAY PARTICIPATE IN A CLASS
ACTION, CLASS-WIDE ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING.
Exceptions. Either party may seek injunctive or equitable relief in any court of competent
jurisdiction to protect intellectual property rights or confidential information.
Informal Resolution. Before initiating arbitration, you agree to first contact us at
legal@aktohcyber.com to attempt to resolve the dispute informally.
We may update these Terms from time to time. If we make material changes, we will notify you
by email or by posting a notice on the Site. Your continued use of the Site or Services after the
changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the
updated Terms, you must stop using the Site and Services.
Entire Agreement. These Terms, together with any additional terms you agree to when
registering for paid Services, constitute the entire agreement between you and Aktoh regarding
the Site and Services.
Severability. If any provision of these Terms is found to be unenforceable, the remaining
provisions will remain in full effect.
Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that
provision.
Assignment. You may not assign or transfer these Terms without our prior written consent. We
may assign these Terms without restriction.
No Agency. Nothing in these Terms creates a partnership, joint venture, or agency relationship
between you and Aktoh.
Export Controls. The Services are subject to U.S. export control laws. You agree to comply
with all applicable export and sanctions laws and not to export, re-export, or transfer the
Services to prohibited countries or persons.
